1. General
These Terms and Conditions ("Agreement") set forth the general terms of your use of the Tarot.Pro mobile applications and website ("Services").
By using or accessing the Services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, please discontinue use of the Services.
This Agreement is legally binding between you ("User", "you", "your") and 137.NL B.V. ("137.NL", "we", "us", "our"). If you are using the Services on behalf of a business or organization, you represent that you have authority to bind such entity.
2. Accounts and Membership
If you create an account, you are responsible for maintaining its security and for all activities that occur under it. You must promptly notify us of any unauthorized use. We reserve the right to suspend or delete accounts that violate these Terms or applicable laws.
3. User Content
You retain ownership of any data, questions, or material ("Content") you submit while using the Services. By submitting a question or request for a reading, you consent to your input being processed by third-party AI services (such as OpenAI GPT or Google Gemini) to generate your reading (or talk to our AI Pro's). We do not use your personal data to train any AI models.
4. Billing and Payments
Payments for premium features or subscriptions are handled through the App Store or Google Play. You agree to pay all applicable fees according to the pricing terms displayed at purchase. If auto-renewal is enabled, you will be charged automatically at the start of each renewal period. We reserve the right to modify pricing or discontinue features at any time.
5. Accuracy of Information
We make reasonable efforts to keep the Services accurate and up to date, but errors may occur. We reserve the right to correct errors or update content without prior notice.
6. Backups
You are responsible for maintaining your own backups of any Content you wish to keep. We are not liable for any data loss or deletion that occurs through your use of the Services.
7. Advertisements
Your interactions with advertisers or third-party offers through the Services are solely between you and the third party. We are not responsible for any resulting losses, disputes, or claims.
8. Links to Other Resources
The Services may include links to external websites or platforms. We are not responsible for their content, privacy practices, or any damage that may result from your use of them.
9. For Entertainment Purposes Only
All tarot readings and content provided by Tarot.Pro are intended for entertainment and self-reflection only. They should not replace professional legal, financial, medical, or psychological advice. Use your own discretion when interpreting any reading.
10. Prohibited Uses
You may not use the Services for any unlawful or abusive purpose, or in violation of intellectual property or privacy rights. Any misuse may result in suspension or termination of your access.
11. Intellectual Property
All intellectual property related to the Tarot.Pro apps, website, and content remains the property of 137.NL B.V. or its licensors. You may not reproduce, distribute, or modify any material without written consent.
12. Disclaimer of Warranty
The Services are provided "as is" and "as available." We disclaim all warranties, express or implied, including fitness for a particular purpose and non-infringement. We do not guarantee that the Services will be error-free, uninterrupted, or accurate.
13. Limitation of Liability
To the fullest extent permitted by law, 137.NL B.V. and its affiliates are not liable for any indirect, incidental, or consequential damages resulting from use of the Services. Our total liability shall not exceed the greater of one euro (€1) or the amount you paid to us during the previous one-month period.
14. Indemnification
You agree to indemnify and hold harmless 137.NL B.V., its directors, employees, and agents from any claims or damages arising from your use of the Services or breach of these Terms.
15. Severability
If any part of this Agreement is found invalid or unenforceable, the remaining provisions will continue in full effect.
16. Dispute Resolution
This Agreement shall be governed by the laws of The Netherlands. Any disputes shall be resolved exclusively by the competent courts of The Netherlands. You waive any right to a jury trial.
17. Assignment
You may not assign your rights or obligations under these Terms without prior written consent. We may assign our rights in connection with a merger or sale of assets.
18. Changes and Updates
We may modify these Terms at any time. Updates take effect immediately upon posting. Continued use of the Services after changes constitutes acceptance of the updated Terms and the current Privacy Policy.
